OK, just doing some quick, investigative work, patents are normally given for 20 years from what I saw, and based on my memory from auditing financal statements. This may or may not be correct. Based on the eightstar page, the firescope appears to have been created between 1977 - 198?. So, doing some quick math, the firescope may or may not still be a patented process. This is just from doing a quick search on patents and reviewing the eightstar site.

If there are attorneys out there, maybe they can correct me.

Fair enough, Brad. If it was patented in 1984, then it appears you are correct from what I have read, and I obviously agree that patent infringement is wrong.

I believe that in the USA patents last for 20 years from the filing date, not the date of grant of the patent (which is a few years from filing).

In terms of renewability, the whole lifespan of 20 years is not given to you at one go. It is given to you a year at a time, and must be renewed every term up to the max of 20 years.

This is my basic understanding of the US patent system.

so do we know when the firescope patent was filed and when it is up? and what exactly is patented? is it the actual images as well as the device?

please correct me if i'm wrong (b/c i'm sure i am) but if someone built their own machine and used it but didnt sell it, would it be in violation of patent law? or is this why the whole image being patented thing coming up?

i'm ready to learn!

Most likely it's the device itself that is patented. The images would fall under copyright. And don't forget contract law - I'm sure there are some obligations with regards to the FireScope or its images in a signed document.

I was actually just discussing a patent case with a lawyer last week, as my brother in law is considering buying out a US based company and I was helping him value it.This company's overvalued goodwill was based on a patent that was to expire in two years time. A patent is only for 20 years from the date that it was filed and cannot be renewed, the rationale behind this is to spur creativity in inventions. One can easily contact the US Patent office to find out the status of the firescopes patent, but if it was filed anytime before 1980 or if a term was not renewed then the patent has def expired and anyone can make their own firescope and publish whatever pictures they choose from it.

I all fairness to Ice, I feel you have before-if obliquely- threatened to take legal action against other posters here.

That is your right. You have a right to protect your name.

If you become known as someone who is quick to say you will use the law to protect yourself, however, you *will* be more likely to be perceived as doing so whenever you say you "know what to do" or any other such phrase.

You *are* perceived as being ever ready to take legal action. In one thread someone (davidt? Marcus?) said he didn't know what you would do about some remarks made about you by Marvin if you considered some other remarks (very tame in comparison) "actionable".
